Does the Creature Dictate to the Creator?

WHERE did the federal government come from? It was CREATED by the Constitution.

WHO ratified the Constitution? WE THE PEOPLE, acting through special ratifying conventions called in each of the States.  So it was The People of each State who ratified the federal Constitution for their State.

So the federal government is merely the “creature” of the Constitution and is completely subject to its terms.

Those are not my words. Those are the words of Alexander Hamilton in Federalist Paper No. 33 (5th para), and Thomas Jefferson in his draft of The Kentucky Resolutions of 1798, under the 8th Resolution.

IT IS IMPOSSIBLE to have a correct understanding of the relation between the federal government and The People unless you understand that the federal government is merely the “creature” of the Constitution. It is not a party to it. The STATES are the parties to the constitutional compact (contract).

THIS is why James Madison said, in his Report of 1799 to the Virginia Legislature on the Virginia Resolutions of 1798, under his discussion of the 3rd Resolution, that THE STATES, as the creators of the federal government, are the final authority on whether their creature has violated the compact THE STATES MADE WITH EACH OTHER. The constitutional compact is between the Sovereign States. The federal government is merely the “creature” of that compact.

That is why the States have the natural right to NULLIFY unconstitutional acts of their “creature”, the federal government.

But our “creature”, the federal government, has taken the bizarre position that the Constitution means whatever THEY say it means.

Oh, do they need smacking down! Does the creature dictate to its creator?

The nullification deniers say, “YES!”

Manly men say, “NO!”

    • Some of the comments reflect an ignorant & closed mind as well as belligerence. I can do nothing for such.

      Our Framers supported nullification of unconstitutional acts of the federal government – I prove it here: https://publiushuldah.wordpress.com/2015/05/03/nullification-the-original-right-of-self-defense/ Others can either read that with an open mind and look up the hyperlinks – or they can continue to wallow in ignorance.

      I also detect fear on their parts – fear to challenge the federal government. Contrast that with the colonials who opposed “with manly firmness” the King’s invasions on the rights of the people. Declaration of Independence, 7th para.

      There is a certain utility to saying “what’s the use” or “how far will that get you”: The person who says that seeks to justify himself for doing nothing ….. except bitching.

      Really our problems are moral.

        • Let me do my chores here – house, kitchen, and such – and then I’ll see what I can do where you posted. The people there must open their minds. It is hard for us to understand this – but many people shut the door to their minds and lock the door and throw away the key. And they get really annoyed when someone knocks on the door. They seem to want to justify closing the door.

  7. Publius, I do believe there are so many people who are fed up with our Federal Government but they do not know where to start. Do you have any suggestions regarding who would be the best person to contact in our state or perhaps you know of groups that are actively working together on solutions. Sometimes the hardest part of finding or helping with a solution is knowing who to contact and where to start! Most folks give up even before starting because they feel hopeless. My grandfather use to complain all the time about political issues, he would have great ideas about what could be done and he would rant on and on, but he would always end his rant by saying, “oh well, what can one person do about it”, as he walked away waving his hands in the air! What was so great about grandpa’s rants were, he had a wonderful Swedish accent, I would listen simply because I adored the sing song in his voice. 🙂

    • I think we need to prepare for the worst. Focus on building networks with neighbors. Our County Sheriff is the most important official. We need men of integrity and wisdom and courage in that office. Sheriff Richard Mack, with his constitutional sheriffs organization, has the right idea.

      What’s needed is a moral and intellectual regeneration of the American People. I fear we will go through a terrible period before we see the light at the other end.

      I enjoyed your story about your Grandfather. I saw a movie recently on TV about Swedish Immigrants who came to America.

        I agree we need more citizen concerned with moral fiber and intellectual matters other than Social Media and their TV stars. But then we have moral intellectuals abounding, We need some of that old fashion grit and gumption to take hold. What a lively thread you have here!

      • Preparing for the worst unnerves me. But, I know you’re right. Beginning with my neighbors is a good start. I would try co-workers but there is this policy, I don’t like it, mostly because I don’t like to be controlled, that would send me to the unemployment lines or computer webpage nowadays! Positively, I will look to my Sheriff, who is wonderful, should our society totally breakdown! I will look into the Constitutional Sheriffs Organization and make sure my Sheriff is a member. I wonder if anyone can join them, I soon will have the answer cause I am a google maniac.

        You have put hours and hours of work into your blog here, I so appreciate looking here for answers. I also share the links to your blog in groups on FB and I just began tweeting again. Dislike Tweeting I am long winded and tweets do not allow for complete expressions, you have to be creative with short sentences minus adjectives. Sharing your video “The Constitution Is Not A Suicide Pact”, never fails, I am called all kinds of lovely adverbs that are not very kind. Amazing really how so many people simply to not want to believe that our History and our foundations are based on Judeo-Christian principles. But I keep plugging away, sharing your videos, because I know I have to do something and tossing a pebble into the lake of ignorance will cause ripples that will wake up a few minds and eventually the truth is recognized and accepted once again, one person at a time. Truth has a way of spreading it just takes a bit longer then I would like, you have to first break down the walls of denial with most people first. Once you break through the denial and they see and understand the truth it’s so nice to know you did something positive for them!

        You are an extremely positive force, not that you can determine that by your reply to me above, but you are!

        Thank you for all your eye opening glorious educational materials found here on your blog. I hope you organize it and put it all in a book soon making sure you include CDs & DVDs of your videos. Your work should be shared and preserved for future generations to read. Including your comments that show your wonderful personality. You are amazing. I hope you know that? .

  8. just curious…..your commentary about the Constitution and how it works, what it created, etc are correct, but what never ceases to amaze me is that you are attempting to apply principles from the several states of the Union, The United States of America, c. 1778, created by the Article of Confederation, and entered into Constitution with the States in 1792, to the current ‘UNited States’, which is NOT The United States of America, but rather a foreign-owned, private corporation created by an ‘act’ of congress Feb 21, 1871, as a ‘Government’ FOR the District of Columbia:

    The “UNITED STATES”:
    (USC 28 Section 3002, No. 15(a) “United States” means a Federal Corporation.) The United States was incorporated February 21, 1871 (16 Stat. 419, Chap. 62, 41st Congress, 3rd Session), the purpose being “an Act to provide a Government for the District of Columbia, reorganized June 8th, 1878, (20 Stat. 102, Chapter 180, 45th Congress, 2nd Session) as “an Act providing a permanent form of government for the District of Columbia” aka US Inc.

    UNIFORM COMMERCIAL CODE (UCC):
    SECTION 6101-6111
    (14) “United States” includes its territories and possessions and the Commonwealth of
    Puerto Rico.

    “UCC 9-307 (h). Location of United States. The United States is located in the District of Columbia.”

    The current ‘UNited States’ is no more the government of the several states of the Union than Federal Express is an agency of the ‘UNited States Government. The US adopted the ‘Constitution, for the most part, although with changes, as the CORPORATE CHARTER for the UNited States, and ALL ‘Government’ you see today is THAT GpvCo that is the ‘Government’ of the District of Columbia, and has been since 1871. it has slowly inserted itself in place of the real government established by The Constitution For The United States of America, mostly by deceit (which has obviously worked, as even supposed ‘scholars’ don’t seem to even know which nation-State they are ‘citizens of, the ‘UNited States, a private corporation, located in DC, or the several states of the Union.

    The ‘people’ aren’t even a party to the constitution. Our rights are natural, creator-endowed rights. They are NOT given to us by the government in America, but they are in the UNited States, where the corporation has given its ‘citizens’ (corporate ‘Individuals’) CIVIL rights, which it can just as easily legislate away. No such thing can happen in the several states of the Union:

    From the U.S. Supreme Court:

    All legislation is prima-facie territorial”
    American Banana Co. v. U.S. Fruit, 213 U.S. 347 at 357-358

    “It is a well-established principle of law that all federal regulations applies only within the territorial jurisdiction of the United States unless a contrary intent appears”
    [Foley Brothers, Inc. v. Filardo, 336 U.S. 281 (1949)]

    “The laws of Congress in respect to those matters[outside of Constitutionally delegated powers] do not extend into the territorial limits of the states, but have force only in the District of Columbia, and other places that are within the exclusive jurisdiction of the national government”

    “There is a canon of legislative construction which teaches Congress that, unless a contrary intent appears, [legislation] is meant to apply only within the territorial jurisdiction of the United States.”
    U.S. v. Spelar, 338 U.S. 217 at 222

    it would appear you are trying to fight a private corporation, in THEIR own boardroom, about THEIR corporate rules and regulations, which YOU ‘voluntarily’ agreed to follow when you signed up for Socialist Security, which is owned by the Crown, and only exists “within the United States” (TITLE 28, §1746), not in ‘America’, and is only available to corporate ‘members of the UNited States, as evidenced by their possession of GovCo corporate IDs like SSNs, drivers licenses, professional licenses, etc.

    You joined ‘Uncle Sam’s Club’, now you are complaining about their club rules…..while you are IN their club, partaking of all the carrots they have dangled for you…….let all that crap go and come BACK to the several states of the Union, where no such bullshit can exist. That is why the bankers created the UNited States,c. 1871, so they COULD control you, They knew they could NOT do it The United States of America, c’1778, so they had to get you to VOLUNTARILY ‘leave’ the several states of the Union (remember when you got you SSN, and you checked that little box “US citizen”, under penalty of perjury?), and become a “FEDERAL citizen”, by dangling all those ‘free’ carrots, like SS, ‘medical’, etc…..as I see pop up occasionally: “remember ALL mousetrap have ‘free’ cheese”……

    “A citizen of the United States is a citizen of the federal government …”

    (15) “United States” means –
    (A) a Federal corporation:

        • I debunked one of the patriot myths in the “Ask Questions” section; but not all of the myths Gary raised.

          They are confused about many things – it comes from reading misinformation and taking things out of context, and never reading and learning our Constitution as a whole. Also, the fact that I have a law degree disqualifies me in their eyes. So they won’t listen to people who really know. Which is why I haven’t taken the time to debunk their myths. People with sense don’t buy into them; and the people who spread the myths REFUSE to listen when their myths are debunked.

          They are totally oblivious of the meaning of the Constitutional provision at Art. I, Sec. 8, next to last clause, which delegates to Congress total jurisdiction over THE DISTRICT OF COLUMBIA. Congress’ powers over the DC are not limited to the enumerated powers. Over the DC Congress has general and unlimited legislative powers limited only by the Bill of Rights. So they read stuff about the DC and think it applies to the whole country.

  9. It just occurred to me how much time I absolutely waste “calling my Congress-Critter”. It is the state legislature I should be concerned with. It is my state legislature that needs to “cowboy up”! I appreciate the role our Sheriffs could /should play but it seems to me it is our state legislatures and attorneys general that need to lead the “War on Washington”! What am I missing?

    Once again PH has clearly illuminated a complex issue into the simple. Shine a light my dear! You are indeed a national treasure.

    • Agreed – Congress is a waste of time and money. We should focus on county & State offices and government. Particularly County Sheriff. THEY could make the federal government almost irrelevant.

  11. I say a loud “NO”! The people are so dumbed down that they cannot believe what you just wrote. They believe that they are subject to the creation and must obey.       • I believe that the truth in this short article is the key to understanding all the rest. If you do not get who the parties were and who it is that established the Constitution, which then set up the Federal Government, you cannot understand what is so wrong with what is going on today.
