Get your State Militia revitalized before it’s too late!

In all questions respecting the Militia, Dr. Edwin Vieira is the authority.  In the 7 minute video below, Dr. Vieira  shows us the difference between the State Militia and the State national guard.

I’m going through Title 58 of the Tennessee Code now compiling “The Tennessee Military Code of 1970”. We don’t have an active Militia (within the meaning of Art. I, Sec. 8, clauses 15 & 16 – and which James Madison described in Federalist Paper No. 46) here in Tennessee. All we have is the national guard which is an adjunct of the federal military (Art. I, Sec. 8, clauses 12-14).

When the islamists the obama administration is importing as fast as they can start the civil war here, we better have our own State Militia organized and ready to defend us. But those are not my words. JAMES MADISON SAID IN FEDERALIST NO. 46 that the purpose of the Militia is to defend us from the federal government.

Alexander Hamilton also said that when the federal government acts against our interests, we must look to our States to defend us (Federalist No. 28 and 29).

I call upon retired military men all over the Country and of all the various branches to get together and look into your State Constitutions and State Statutes and find out the Status of your State Militia. It may be that we will have to go back to the State Militia laws which were in effect before the State Military forces were federalized as a result of the Dick Act of 1902.

We better un-federalize our State military forces before the trouble starts.  We can not depend on the US military to defend us. Obama is purging the US Military of good men. All that will be left will be his thugs & bullies – and of course, transgender people and such like.

Freedom isn’t free – as we will soon find out.

  1. I am a Retired (brain surgery) US Army vet. living in Colorado Springs, CO. There are a lot of militia groups in our area. Which of these would you suggest that I offer my services. I just moved back a year ago, and am unfamiliar with them.

    • It was stated that there is no provision for a private militia, and I would take that to heart before doing anything. What I would suggest is that you contact which ever you can, and ask them some simple questions.
      1. Do you know that there is no lawful provision for private militia?
      2. Have you contacted your state legislature to educate them on the constitutional mandate for Militia?
      3. Do you understand the full extent and authority of the Constitutional Militia?
      4. Do you understand that the National Guard does not meet constitutional authority?
      5. Do you understand that there can be no such thing as an unorganized militia without a constitutional amendment?
      6. Have you petitioned your state to revitalize the Constitutional Militia?

      • Nick! Where have you been all my life? You are right in what you say.

        It is imperative that organized armed groups be lawfully constituted.

        We don’t want armed gangs led by warlords – and that is what “private” militia groups amount to.

        Under the Doctrine of The Lesser Magistrate, if the State governments won’t establish the constitutional state militia; then lawfully elected County Sheriffs may organize armed posses [as Sheriff Richard Mack describes].

        But the best solution is for The People to learn our two founding documents and then RECLAIM their State and County governments.

        • Waiting for that moment in time when my country called again.
          This is that time when we must come together, and work to restore sovereignty to the People as our Founders intended.
          We’ve elected a new president, one I hope who will act in the same vein as those who made this a country that was great, and prospered in both wealth and liberty. We are already seeing discontent brought about by lies, propaganda, and an incredibly ignorant populace. Once again that discontent is displayed by those who claim to be “liberal”.
          We need to revitalize the Militia in order to restore the republic as it was intended. I’ve attempted to present plans to revitalize the militia in a number of ways, but no takers. I’m still hopeful.

          • Nick, when I was teaching myself the Greek alphabet, I had the most difficulty with the Greek letter for the long e: it looks like the English n. So I had to go over & over it so as to get it burned into my brain.

            I think it is the same with learning our federal Constitution – and particularly about the Militia our Framers had in mind. I have been a lawyer for over 40 years, and had no idea what the Militia our Framers had in mind was UNTIL I read what Dr. Edwin Vieira wrote about it. His archives are here:

            Then I saw how what Vieira wrote tied in with what’s in The Federalist Papers and in the facts of our History re the Militia.

            So we have to repeat it over & over & over until it sinks in.

  3. I think most people are missing the fact that more than half of the States already have a form of state militia already on the books and in place. I am speaking of State Defense Forces or State Guard units. These are state military forces under the control of the Attorney General and Governor of the State and are separate from the National Guard or federal military. The State Guard Association, of which I was a member when I served in the Louisiana State Guard, has been trying for years to get more recognition of these legal militias. Sadly, instead of seeing the militias get more training and missions, we have seen them disarmed, disbanded or just allowed to wither away with no purpose. I quit the La State Guard when I realized that I could better serve my community as a member of the local Volunteer Fire Department. In the State Guard I was put in an office doing some minor tasks or taking a few Emergency Management classes but never called up for any actual missions. Few State Guard/ Defense Forces have enough manpower or resources to be of much use and are virtually unknown to the citizens they serve. The Louisiana Military Department doesn’t even mention the State Guard on it’s webpages.

    • Precisely.
      One has to check the State Military Code to find out the exact legal status of the Militia described at Article I, Sec. 8, clauses 15 & 16. If they exist in any State, it’s in name only.

      The States loved having their State military federalized – they got federal appropriations for going along with it !!! whoopee!

    • There are several issues in this attempt to revitalize the Militia.
      I have actually applied to my state under the statutes for a position in Militia, and received a response advising that I should join the National Guard. I explained that the National Guard is not the militia, but did not receive a response after I repudiated the states ignorance.
      I’ve also contacted every member of the state legislature with information on Militia, and challenged anyone to debate in open forum. I’ve not received one response.
      I have engaged supposed pro-second groups, and taken time to explain what Militia is, and why it is the answer to gun control. They want nothing to do with the facts, but would rather waste time fighting for concealed carry, something that obviously would not be necessary once Militia is revitalized.
      A big part of the problem is that organizations such as the NRA have spent decades misleading the membership. Dr. Vieira sent a letter to the NRA that essentially asks why they avoid the topic. I had previously done so, but like Dr. Vieira have not received a response.
      I’ve presented a few different strategies, including addressing the Emergency Preparedness statutes that ignore you and me. The mindset is so locked into the individual rights theory that it is difficult, at best, to break through. Even pointing out the ridiculous notion of a constitutionally impossible “unorganized militia” that is essentially impotent has not moved any I’ve spoken to
      Ultimately, it is ignorance and pride of the people that prevents the revitalization. The majority will not admit that they’ve been duped.

      • What you say is True. For the most part, I get the same response.

        I think our job now is to go on doing what we have been called to do – even though to us it seems fruitless – and trust in God to handle it. I expect America is in for a terrible scourging. But The People deserve it.

  4. PH, how about an update on how it’s going with the revitalization of your states militia.
    Those opposed to it and why. and really just a record of what you’re doing as a record.
    Also the biggest reason to help others who may be trying to do this in their state.

    • It takes a while for people to grasp the distinction between the Militia addressed in our Constitution and the Federalist Papers, on the one hand, and the National Guard in their State. If people would read about the Militia in our Constitution, they would see that the federal gov’t may NOT call up the Militia to fight in wars overseas. And they would see that the fundamental purpose of the Militia is to defend the States from the federal gov’t.

      There is the problem of federal funds: States get federal funds for the National Guard.

      There is the problem that Americans aren’t interested in this issue. Americans are interested in gossip, celebrities, and such.

      Understanding the issue requires an attention span of at least 5 minutes. If something can’t be grasped in 20 seconds, Americans won’t get it.

      But the biggest problem of all is this: Americans are so conceited! They aren’t interested in “Truth” – all they care about is their own opinions. And they are unaware that they have been indoctrinated to hold the opinions they have.

      Dr. Edwin Vieira has been addressing this issue for YEARS! And even though it is one of the most important issues of our Time, people aren’t interested. But post something about the hole in Hillary’s tongue, and you will spark interest and lots of “opinions”.

      Nevertheless, I’m speaking in Cincinnati on Constitution Day (Sep 17, 2016) and I will talk about the Militia.

  5. So, with recent State constitutions that do not include a militia we the people of the State need to have our legislatures amend the state Constitution to include a militia. What a daunting task.

    • Your State Constitution probably already provides for a Militia. You can probably find your State Constitution on-line.

      What we need to do is get our State Legislatures to pass laws revitalizing our State Militia and disbanding the national guard. The national guard is merely an adjunct of the federal military.

  7. PH, so how do we start a militia when the states are supposed to have already done that? What authority do We the People have to start a Militia? I am all for the idea but I am not aware of any process written to show us how to get it done. Any thoughts would be most appreciated as I am in complete agreement with you as to the absolute need for Militias of the States.

    • The People don’t have the authority to start a militia on their own.

      Do listen to Dr. Vieira’s 7 minute video – he says a lot in 7 minutes.

      State Legislators are like everyone else – they go with the flow. WE THE PEOPLE must rise to the occasion. We must learn this stuff and then tell our State legislators.

      You have to see what your State Constitution says about the Militia; then find out what your State Statutes say; then get with retired military men and learn all this and then teach your State Legislators.

      I plan to find out what my State’s militia Statutes said BEFORE the Dick Act of 1903. The Dick Act is what federalized the State’s militia. I expect federal funds were involved…..

      You. I. Others we recruit. It’s on our shoulders to get this fixed. If we don’t fix it, we will be killed by the Islamists.

  8. Since states control the Militias according to the Constitution, how can “we” get one formed when we do not control the states, but they function largely at their own discretion with little to no input from We the People?

    • State Legislators don’t know this stuff. Heck, 99.9999% of the People don’t know. So we must tell them. And it’s important that all know that we are talking about the Militia recognized at Article I, Section 8, clauses 15 & 16, US Constitution; so that People don’t think we are talking about the private militia some misguided patriots are involved in. We elect people to our State legislatures who know nothing. They reflect the People who elect them. Citizens must learn the Constitution and what needs to be done and develop personal relations with their State Legislators. Outside special interest groups have been able to come in and influence State Legislators because their own constituents aren’t doing it.

  11. Unfortunately the North Carolina State Militia was deactivated after there was a workman’s compensation claim by someone back in the 1990s.

    I suppose I could write the governor and just ask him to give us our militia back.
