Mark Meckler’s “COS” Board Member has drafted new Constitution which imposes gun control

Our Framers understood that a free State cannot exist without an armed and trained populace (i.e., the Militia). Accordingly, they wrote a Constitution which prohibits the federal and State governments from infringing the natural right of the People to keep and bear arms.

Under our Constitution, the federal government has no authority to make any laws whatsoever over the Country at Large restricting the rights of the People to keep and bear arms. Gun control is not an enumerated power. Furthermore, the Second Amendment expressly forbids the federal government from infringing the right of the People (the Militia) to keep and bear arms.

The States are also prohibited from infringing the right of the People to keep and bear arms by Article I, Sec. 8, clauses 15 & 16, US Constitution. Those two clauses provide for the Militia of the Several States; and implicitly prohibit the States from making any laws which would interfere with the arming and training of the Militiamen in their States. 1

Applications for Congress to call a convention under Article V, US Constitution

But various groups, such as Mark Meckler’s Convention of “States” (COS) organizations, have been lobbying State Legislators to pass applications asking Congress to call an Article V Convention.

Whether or not State Legislatures should ask Congress to call an Article V Convention is one of the most important – and contentious – issues of our time. The Delegates to such a convention, as Sovereign Representatives of the People, have the power to throw off the Constitution we have and propose a new Constitution, with a new and easier mode of ratification, which would create a new government. 2

The Pennsylvania Senators Roundtable Discussion

On November 8, 2021, several Pennsylvania Senators conducted a roundtable discussion about whether they should pass Mark Meckler’s “COS” application (SR 152) for Congress to call an Article V convention. Mark Meckler and his allies were present in support of SR 152. Firearms Owners Against Crime was present in opposition to SR 152. Gun Owners of America was there also. 3

Much of what Meckler said at the roundtable is not true. But this paper focuses on his comments ridiculing his opponents’ concerns that, if there is an Article V convention, we could lose our existing Right to keep and bear arms.

Meckler showed up at the roundtable decked out in gun garb; and, after dropping names to show his connections with gun rights organizations, proceeded throughout the discussion to preen his commitment to “the Second Amendment”. He ridiculed the warnings that if there is an Article V Convention, Delegates would have the power to impose a new Constitution which, among other horrors, strips us of our Right to keep and bear arms without infringement.

Meckler said that Chuck Cooper, a litigator for the NRA, is on COS’s Legal Advisory Board and has written an open letter saying, “…it’s a ridiculous argument that there could be a runaway convention and we could lose our Second Amendment.” [13:31 – 13:57]

A bit later on, Meckler said:

“…Professor Robbie George at Princeton who is considered the foremost conservative constitutional scholar in America is on our Legal Advisory Board. … [43:02 – 43:25]

So who is Professor Robbie George? And who says he is the foremost conservative constitutional scholar in America?

Robbie George (Robert P. George) was on the National Constitution Center’s Constitution Drafting Project. The National Constitution Center is a quasi-official branch of the federal government.

Robbie George and three others have drafted a new Constitution which severely restricts the Right of the People to keep and bear arms! His new Constitution says at Article I, Sec. 12, clause 7:

“Neither the States nor the United State [sic] shall make or enforce any law infringing the right to keep and bear arms of the sort ordinarily used for self-defense or recreational purposes, provided that States, and the United States in places subject to its general regulatory authority, may enact and enforce reasonable regulations on the bearing of arms, and the keeping of arms by persons determined, with due process, to be dangerous to themselves or others.”

So Robbie George’s new Constitution:

  • authorizes the state and federal governments to ban the possession of all arms unless they are “ordinarily used for self-defense or recreational purposes”. Who will decide what arms are “ordinarily” used for self-defense or recreation? The governments will decide.

  • authorizes the state governments and the federal government (in those places subject to its “general regulatory authority”), to enact and enforce “reasonable regulations” on the bearing of those arms they permit us to have. What’s a “reasonable” regulation? The governments will decide; and,

  • authorizes the state and federal governments to strip us of our right to keep even those arms “ordinarily used for self-defense”, if someone in the government (presumably a judge) decides you are a danger to yourself or others.

We live in a time when Christians who read the Bible; People who read the Constitution; and Moms who speak out at School Board meetings against pornography in the schools, mask mandates, or the teaching of critical race theory, are labeled “domestic terrorists”.  Should “domestic terrorists” be allowed to keep and bear arms? Of course not- they are dangerous!

At the roundtable, John Velleco of Gun Owners of America said:

“The questions that we’re dealing with on this is how will this [Meckler’s “COS” application SR 152] impact the Second Amendment? Because that’s, as an organization, that’s all we care about. … So we need to determine if this is something that seriously could impact in a negative way the Second Amendment, then we are compelled to engage 100%. … our bigger issues in Pennsylvania are passing constitutional carry.” [1:07:05 – 1:07:51]

Yet even though Meckler’s Board Member Robbie George had already participated in the drafting of a new Constitution which imposes gun control; and thereby would rescind the Second Amendment, Meckler responded:

“And I will tell you there are 5 Million people in this country … that are signed up for convention of states. Right here, there are 90,000 in this state. 90,000!

The question was asked, will this help pass constitutional carry? The answer is hell yes, it will! Because right now, our activists are very angry with gun rights organizations in this state. And they’ll not support anything that these gun organizations are doing, because they’re now sworn enemies on Article V. … But I will say, on Kim Stolfer’s organization, they should be working with these organizations. Every one of those 90,000 should be signed up with these organizations and members of these organizations fighting for everything they [the gun organizations] want.” [1:21:21 – 1:22:05]

So Meckler, who postures as a “Second Amendment guy” [13:31-13:57] , threatened that unless Kim Stolfer supports Meckler’s SR 152 application for a convention, Mecker’s alleged 90,000 supporters in Pennsylvania 4 will not support anything Kim Stolfer’s gun rights organization does!

Look behind the Curtain

This push for an Article V Convention is the most vicious bait and switch ever perpetrated on the American People. It’s all about getting a new Constitution under the pretext of getting amendments. 5 If Congress calls an Article V convention, Robbie George’s proposed Constitution, or another just as tyrannical, can be proposed. 6 And since any new Constitution will have its own new mode of ratification (such as a national referendum), it’s sure to be approved.

The solution to our political and economic problems is to read and enforce the Constitution we already have. States and local governments and individual Citizens can take a giant step forward by not taking federal funds to participate in unconstitutional federal programs.

And rescind your States’ existing applications for an Article V convention! It doesn’t matter what the ostensible purpose of a convention is, as set forth in a State’s applications. Once the Convention assembles, the Delegates can do whatever they want including approving the Constitution Robbie George participated in drafting, or another Constitution which will also legalize the tyranny which is taking over our Country.

We are to fight tyranny by resisting it; not by legalizing it.

1 With the Militia Act of 1792, Congress required all able-bodied male Citizens in the Country (with a few exceptions) between the ages of 18 and under 45 to buy a rifle, bayonet, ammo & ammo pouch, and report to their local Militia Unit for training. States may not lawfully do anything to interfere with this constitutional grant of power to Congress.

6 Altogether, the National Constitution Center has three proposed new Constitutions. All of them transfer massive new powers to the new federal government.

Additional proposed Constitutions are discussed here.  One of them, the Constitution for the Newstates of America, was produced some 60 years ago [and factions have been pushing for an Article V convention ever since]. Under the Newstates Constitution, the States are dissolved and replaced by regional governments answerable to the new national government. Article I, Part B., Sec. 8 provides that the People are to be disarmed. Article XII, Sec. 1, provides for ratification by a national referendum – so whoever controls the voting machines will determine the outcome.

    What I can’t wrap my arms around is this: how these CoS proponents lie and say that there won’t be a runaway convention when the original ConCon (i.e. 1787) WAS itself a runaway convention! Wasn’t the original 1787 convention tasked with improving our first constitution, The Articles of Confederation? Didn’t the delegates in Philly scrap the Articles, then craft the COTUS we now have? If it can happen once, why can it not happen again? I’m just wondering; I’m just spitballin’ here…

    • In the public schools, Americans were so dumbed down that they will believe whatever they are told. Men can get pregnant and breast feed their babies. Tampons should be available in “men’s” restrooms. A woman is a man if “he” says so, and you better refer to “him” as “he”.

      When dealing with the Constitution, there is an additional problem: Americans know nothing about our Founding Principles and Founding Documents. Nothing. A survey said that only 26% of Americans can name the 3 Branches of the federal gov’t. Didn’t Alexandria O. Cortez identify the 3 Branches of the fed gov’t as “the Senate”, “the House”, and “the other one”?

      “Reality” is whatever each person says it is – that’s “reality” to him and you better respect it.

      Those pushing for an Article V Convention exploit the mental & moral corruption of the American People.

      The legal guru for the convention pushers, former law professor Rob Natelson, tells them that the States will select and control the Delegates to a convention, and the lemmings believe him. Natelson tells them that “customs” practiced during hundreds of what he claims are previous “interstate” conventions, show us exactly how a convention called under Article V will operate. He doesn’t mention the federal convention of 1787. In my opinion, Natelson is a hack, or is insane, or is really, really stupid. After I read and commented on several of his published papers, I believe I understand why he was denied Emeritus Status when he left the law school where he taught.       One of the favorite sins of Americans is blame-shifting. The Truth is that the federal gov’t was able to take over all aspects of our Country because the State and local governments, all our institutions, hospitals, farming, etc., etc., etc.; and the People willingly sold their retained powers to the federal government. They did it to get federal funding. But now that our final collapse is just around the corner, they don’t want to acknowledge that it’s THEIR fault! So they want to blame-shift and blame the Constitution. The Constitution is what needs to be fixed!

        I can’t deny any of that. The dumbing down is horrific as it is astounding. Only 26% of Americans can correctly identify the three branches of gov’t? That’s basic stuff everyone should know! I remember shaking my head at AOC’s comment. I’m also appalled at her ignorance in economics, for which she supposedly holds a degree. Didn’t she learn anything at Boston U? Charlotte Iserbyt detailed all this in her book about dumbing down education.

        Even so, people could check things out for themselves. The thing that prompted me to check out CoS was simply because it sounded too good to be true. I’d listen to Mark Levin during my drive home from work, and boy, after a long, 10 hour day, CoS sounded good! It sounded too good. My late mother always admonished me that, if something sounds too good to be true, there’s likely a reason for that.

        Between sounding too good to be true and Levin’s mockery of those who called in to disagree with CoS, I checked things out for myself. I found myself here. While I knew what the Founders had done in 1787; while we were taught about the Philly convention in school; we were just told that it happened and that they scrapped the Articles. It didn’t dawn on me until you reminded the readers of this.

        If nothing else, then simple logic should lead one to question CoS. All one has to do is ask the following question: if the Feds aren’t obeying the present COTUS (i.e. the one we have now), then why would they obey a revised one? That alone NUKES CoS! That alone destroys CoS. Combine that with the fact that the delegates to the Philly convention scrapped our old COTUS, the Articles of Confederation, how can anyone not see that, if it happened once, it can happen again?

        Those are my rambling, disjointed thoughts. All I can say is that we’re living in Bizzaro World…

The same North Carolina “Republican” Party that INSISTED the “marriage amendment” was so important and will not seek to remove it despite gay marriage being legalized by the Supreme Court is now insisting “trust us” with a COS. (The “marriage amendment,” if you dare to read it for what it actually says, actually denies the marriage of Jesus and the Church as the ONLY “legal union” is between a married man and woman, and then gives exceptions to corporations that don’t go to churches.)

    People don’t want to hear this. They are looking for the next political savior to “save” them.

    Try Jesus instead and stop falling for this!

  3. I attended a supposed “freedom festival” in Pennsylvania in 2020.  There was a booth for a Second Amendment Sanctuary petition.

    Their actual petition says words to the effect that they want the county to be a second amendment sanctuary; that new gun laws are not needed, only need aggressive enforcement of existing gun laws. Their website is here:Pike County Second Amendment Sanctuary – Home | Facebook

    Notice their statement:  “Denial of the right to bear arms is a direct violation of the Constitution. We do not want the state to pass any new laws that will infringe on these rights” “We do not want the state to pass any NEW laws that will infringe….” because they are totally okay with the existing infringements and they do not seek to have any of them abolished/repealed or restitution made to people harmed under those unconstitutional “laws.” They say so themselves:Opinion: Pike County Second Amendment Sanctuary Petition (waynepikenews.com)”We are not seeking to change any of the existing laws…”

    I asked the organization’s leader how they can call themselves a 2A sanctuary if they support enforcement of existing infringements.  He responded by calling me a 2A extremist who is no good for the 2A community. So much for shall not be infringed.

    Gun Owners of America also had a booth at this event, so I went and spoke with Val Finnell, the PA GOA state rep.  I asked him if he saw the fake 2A sanctuary booth and their petition; he looked at me confused and said, “GOA helped them write their petition.”  So I asked Dr. Finnell, “You’re saying GOA helped that guy write a 2A sanctuary petition that supports enforcing existing infringements?  That means GOA supports infringements, but you call yourselves a no-compromise 2A organization.”  Dr. Finnell said, “Have a nice day,” and walked away, ending the conversation. What’s also interesting is that this 2A sanctuary group’s Facebook page urges people to contact Trump to ask him to rescind his endorsement of Dr. Oz for US Senate for PA because Oz supports red flag laws, yet it was Trump who promoted red flag laws more than any other president in history, and Trump did more harm to the 2A than any other president in just four years.

    • Can you send me a legible copy of the signed resolution by Pike County? I found one online which was so small I couldn’t read it. and I found another much longer edition which wasn’t signed and the lines were so close together I couldn’t read it.

      So I need a good copy of the actual signed document. It’s hard to believe that anyone would write a resolution which is as bad as the one you describe!

GOA while purporting to be defenders of the right to keep and bear arms, erroneously views the 2nd Amendment as the source of that right, but they also strongly support “incorporation doctrine” applying the Federal Bill of Rights to the States. GOA is wrong on both counts. The 2nd Amendment did not create or grant any right at all, but restricted FedGov from infringing on a pre-existing right. As far as incorporation, no-one in the founding generation ever for a minute thought that the Bill of Rights applied to the States, it wasn’t until the Supreme Court magically found incorporation in the 14th Amendment expanding FedGov’s ability to interfere in State matters making everything a “federal issue.”

    • what you said about the Constitution is 100% True. I have been very disappointed in our inability to connect with GOA and other organizations which simply will NOT listen to facts and arguments which contradict their existing belief system.

      Americans have become so intellectually corrupt that once they form a “belief” or “opinion” [which they got conditioned to hold]; they judge everything they hear by whether it affirms or contracts their existing belief. If it affirms it, they accept it. If it contradicts it, they reject it.

      I expect that is what dooms our Country to complete destruction.

      And you can’t even get thru to people – much less an organization.

And if I may suggest, some weeks ago you and I shared a thought on the “pandemic” (FRAUD/MANIPULATION/LIE) that if this continued, you might need to rename it for 2022, it now certainly appears Mengele Jr and his sycophants will not relent in their efforts to force everyone into getting the chemical injection referred to as a “vaccine”, which allows little option for critical thinking intelligent adults.     Meckler is worse than a blind bull in a china shop.
    Meckler has intent.
    A Convention of States would definitely open the door to the tyranny of the highest order.
    Our 2nd Amendment is still operating in a fair fashion. And we are exercising our 1st Ammendement here on this page.
    Pressing for a Convention of States simply because of a perceived notion that that might solve a nonexistent problem is foolhardy.
    I was made aware that there have been over 4 million new gun owners this year making their first purchases in their life. I doubt that they are wanting a Convention of States. They are making use of the 2nd Amendment.
    We must make our people understand that this Country’s Constitution is not in such a sad shape as to require a complete overhaul. We however must oust the corruption that has been installed in the Offices.
    Each and every one of us needs to examine how we might be contributing to the corruption. Then make changes in ourselves.

  9. I’m from Pennsylvania. Need I say more? I got through the plandemic without fear. I got through the vaccine mandate without it. I got through the climate change hysteria with the weather – lol. I got through the massive tsunami of propaganda by seeing thru it. But I will NEVER get through, or over, the loss of our right to keep and bare arms without a fight!!!

  10. The so-called “PATRIOT ACT” surely was waiting on the shelf for justifications that arose in the false narratives about nine eleven. Surely, the new, improved constitution is already written and waiting on public to rise up to change the Constitution. Why can’t we have a preview of the “new” constitution without having to hold an Article V convention … a “con-con”?

        • And last night I met a young woman from Australia (I’d say she was in her early 30s or so) who had only recently arrived here on a visa. That woman told me that the disarming of the Australians some 22 years ago (I think it was) had NOTHING to do with what is going on in Australia today. It’s hard to believe how people swallow the propaganda they are fed.

  12. Article V Calls for “a Convention for proposing Amendments” is not a convention for ratifying pre-convention amendments. Calls are to be just that, Calls or general Calls. Just like the first two Article V Convention Calls that were from Virginia and New York.

    Specifically worded or general subject matter Calls are attempts to conflate two separate functions of the same body, one, under their state constitution which is an act of a State Legislature that requires the signature of their governor. The other, an Article V “Application of the Legislatures” whose only function is to Call for a convention. Anything more or less then this is unconstitutional.

  13. As I understand it, mostly learned from reading you, our Rights are bestowed by God and supersede this and any other laws of men. Had the Bill of Rights not been written, we would enjoy our Rights all the same. Our Rights cannot be taken from us, we can only relinquish them.

    I do not support the CoS, and I really appreciate your writings to describe why we should not undertake it.

    But, as I’ve seen you mention, the Citizen holds all the power and grants whatever authority to govern there is, to the governing body and can withdraw that grant and consent at any time.

    We but need to recognize this. We wouldn’t be in this situation today if we but did.

    • We the People are going to have to stop it and we better do it now. We are rapidly running out of time. I’ve been fighting this for some 10 years; but most Americans are ho hum, they are more interested in the latest scandal and rubbish posts.

      We must raise the alarm and get people and organizations to join us in the War to keep our Constitution. Our enemies want to get rid of our Constitution. Mark Levin, and a host of other fake “Conservatives” and fake “Christians” are pushing for a Convention.

      We must wake up our fellows and organize them and then make Delegations to their State Legislators and demand that they rescind all of their State’s existing applications for an Article V Convention, and not pass any more.

      If you tell me what State you are in, I can give you the Status of your State.
